Also not familiar with French law on this subject. but I know that in the U.S., refuse to serve means just that. You turn them away and refuse to serve them.
You don't, as apparently happened here, invite them in, tell them it's okay, take their order and their money, and then kick them out before they finish their meal.
More importantly, you don't physically assault them.
