So, I think the main point of the comic was the witty way to comment on a book, not the specific commentary. To that end, I've made a site where you can generate your own version that says whatever you want about whatever book you want.

I don't think you need the "used without permission" there so long as you credit the source. Creative Commons and all that...

Using without permission whilst crediting the source only becomes an issue if the medium you are publishing the comic in has a turnover, say if you paste them into the funnies pages of a student magazine and charge 50p a copy.

You might be interested in the "making xkcd slightly worse" community: viewtopic.php?f=2&t=22741 & http://xkcdsw.com/ , a similar mindset of rewriting and editing xkcd strips for new punchlines or entirely new content.
